Abstract: THIS Convention is No. 47 of the European Treaty Series which has been prepared by the Expert Committee on Patents in the Council of Europe to provide a basis of uniformity on certain features of patent law, and which is intended to contribute to the creation of an international patent. Patents shall be granted (and only granted) for inventions which are susceptible of industrial (including agricultural) application, which are new and which involve an inventive step; but States are not bound to grant patents contrary to ordre public or morality, or for plants or animal varieties or biological processes (other than microbiological processes and their products). The state of the art includes everything made available to the public before the date of the patent application or of a foreign application the priority of which is validly claimed. States shall additionally consider patent applications of earlier priority even if not published as comprised in the state of the art. A patent shall not be refused only because the invention was made public within six months before application due to evident abuse, or display at an international exhibition.
