Abstract: Dentro del actual contexto posmoderno, en donde la noción de familia ha cambiado radicalmente, mención especial merece el dispar reconocimiento de las técnicas de fertilización asistida y sus efectos jurídicos. Tal como ha reconocido la Conferencia de La Haya de Derecho Internacional Privado, la maternidad subrogada es un “negocio global”. En efecto, la diversa regulación en los derechos nacionales motiva que estos acuerdos se celebren entre personas situadas en países distintos abarcando, en la práctica, los lugares más distantes del mundo, dando lugar incluso a lo que se denomina “turismo procreativo”. Las consultas en materia de maternidad subrogada tanto por parejas homosexuales como heterosexuales aumentan día a día y se mediatizan casos que demuestran la importancia de prever estas situaciones que ya están sucediendo y que proyectan efectos en nuestro país. De allí, la importancia de analizar esta delicada cuestión a la luz de la legislación y de la jurisprudencia argentinas.

Abstract: Despite the abundant legal literature and information available, several key issues of compliance, ranging from its own conceptual scope to its relationship to other similar disciplines and its fit within the criminal law system, remain unclear. This paper starts from the hypothesis that its eminently practical nature has led to contempt the conceptual approaches of this phenomenon. The purpose of this contribution is to clarify what is meant by criminal compliance and to explain its connections with economic criminal law and corporate self-regulation, as well as to analyze its compatibility with the principle of legality.

Abstract: On March 14, 2012, ICC Trial Chamber I issued the first judgment in the history of the International Criminal Court, convicting Thomas Lubanga Dyilo, a rebel in the Democratic Republic of the Congo (DRC). It was discussed in the judgment, among other issues, the concept of ‘active participation in the hostilities’, as an objective element of the offense consisting of conscripting or enlisting children under the age of fifteen years into the national armed forces –or armed groups– or using them to participate actively in hostilities. In a strong separate and dissenting opinion, Judge Elizabeth Odio Benito criticized the view on the issue adopted by the majority, because the sexual acts that boys and girls had been forced to do by the members of an armed group were not considered as an active participation in the hostilities. In the following article this pro-victims approach will be criticized, and the author will try to demonstrate that Odio Benito’s opinion infringes two basic legal principles of international criminal law: the legality and culpability principles.

Abstract: The aim of this paper is to undertand if current criminal proceural laws of the Argentine provinces are adjusted to cientific criteria regarding recognition, and whether there are differences amongst them. Using a comparative scheme, the paper analyzes if judges resolve recgonition orders, if the defendant’s attoney is notified, if double-blind techniques are applied and whether the full process, including all steps, are followed. The paper suggests that procedural laws are not in line with testimony psychology given that many scientific cirteria are not followed, and many of the laws considered are different in inception, implying different implementation and results.
