This working paper collects the contributions to the first external workshop within the ERPL project that took place on 4 and 5 May 2012 at the EUI. The workshop aimed to clarify the key parameters to be used for analysing the claimed transformation process of European Private Law from ‘Autonomy to Functionalism in Competition and Regulation’. Apart from the papers describing the features of the transformation process, separate sessions examined the four parameters (or possible scenarios) around which the project is conceptualised, (1) conflict and resistance, (2) substitution and intrusion, (3) hybridization and (4) convergence. These parameters were examined from a theoretical perspective, but also for their more specific implications for the project design and for testing the hypothesis of the emergence of a self-sufficient or self-standing European Private Law. Apart from the presentation of the project members’ research, contributions from eminent scholars in European private law provided an outsider’s view on the parameters. Finally, the working paper also includes some of the comments offered at a round table that critically examined the project design.

Passee l'euphorie libertaire, nul ne presume plus qu'Internet echappe a la reglementation et au pouvoir, la question etant desormais de savoir sous quelles conditions s'exercent les differentes formes d'autorite. Ces questions sont prises en charge par un ensemble heterogene d'acteurs et ont fait l'objet d'une litterature importante, provenant de diverses disciplines, avec des resultats souvent ponctuels et peu conceptualises. Ce rapport a ete produit a l'issu d'un seminaire conduit dans le cadre du Reseau thematique pluridisciplinaire "Droit et systemes d'information" du CNRS. Il propose une synthese de ces questions, pour mieux comprendre les enjeux actuels de la gouvernance d'Internet et identifier des problematiques de recherches futures.

The private law dimension of the EU regulatory framework for electronic communications : evidence of the self-sufficiency of European regulatory private law

Advertising is a booming activity both in the physical realm and on the Internet. Online advertising is growing and is subject to legal standards, although some self-imposed ethical standards for the industry are needed. This has been called self-regulation. This article examines the important role that self-regulation (in the form of ethical standards) can play in addressing advertising that uses degrading and discriminatory images of women that compromise their dignity. Sexist advertising is a reification of women—stereotypes and sexist social models—that do not convey a realistic image of a woman’s abilities and potential. This article analyzes specific decisions on the subject issued by the Jury of the Spanish Association for the Self-Regulation of Commercial Communication. The Jury’s decisions are based on a code of ethics. The technical expertise and impartiality manifested in its decisions have produced a high degree of credibility and confidence in the organization.
