Esthetic beauty clinic is many people’s need, but the critical point of protection for its patients is still weak. Many problems often affect the patients of esthetic beauty clinic. Patients deserve protection of medical service standard constituting something important to maintain and to improve. Forensic and toxicological medical sciences are needed to give adequate protection to the patients of esthetic beauty clinic. Through its scientific method, the state could prove, prevent, and take action all at once against the esthetic beauty clinics operated haphazardly. The clinic selling, concocting, using, and promoting hazardous and toxic drug and cosmetic can be detected and acted on, while forensic test was intended to prove the consequence or output of esthetic beauty clinic’s service. This scientific method supported the protection and the right of patients of esthetic beauty clinic, corresponding to the constitution.

Forensic and Toxicological Tests for Protecting the Patients of Esthetic Beauty Clinic as the Constitutional Right in Indonesia

Cosmetic is one of pharmaceuticals preparation, with the vigorous cosmetic advertising in print media, electronic media or internet, communities are faced with cosmetics advertising, in which mostly are offering for skin care, especially women to get the skin whiter and brighter. Cosmetic advertising based on Ministry of Health regulation no. 386/Menkes/SK/1994. The objective of this study was to know the beauty clinic services and using of cosmetic for beauty clinic attendees and affecting factors. The assesment was based on qualitative methode at beauty clinic at Jakarta, Indonesia. The data collected was by indepth interview to the beauty clinic attendees, clinical officers and medical doctor as information resourses, and observation of beauty clinic services. Data analysis was done by triangulation. The results shown that characteristics of beauty clinic attendees were  almost all female. The age of beauty clinic attendees are various from teens, middle-aged ( 40 years. The reason of the beauty clinic attendees were to get healthy faces, bright and shining faces. Supporting factors were access to services, financial, transportation, and cosmetics advertising messages. Reinforcing factors that beauty clinic attendees still come to the beauty clinic for skin care were the influence of husbands, brothers and friends, sense of comfort and cool when using of cosmetics from beauty clinics. Beauty clinic services were quite satisfactory, both from the administration, pharmacy, nurses and medical doctors. Most of informants felt the positive effects of using of cosmetic from beauty clinic, the skin becomes white, bright and shining, when it is used based on rules. However, informants felt the negative impact of skin more dull, not shiny, uneven skin color even if it is not regularly use. We recommended that goverment to guide and supervise intensively of beauty clinic services.

Beauty Clinic Services and Using of Cosmetic for Beauty Clinic Attendees at Jakarta, Indonesia

The issuance of policies in the legal education sector leads to trade-offs among the stakeholders. They cannot resolve the problems, leading to in negative excess. Education in Indonesia is often used as a means of legalizing some interests. The issuance of various public policies in the legal education sector through the “Freedom to Learn” policy should produce Indonesian people who are educated and trained in the legal sector and honest and have integrity. The process of legal education occurring so far often does not prioritize moral and religious education, producing people who bringing the trouble to the nation and the state. Thus, Indonesia's corruption index is on the 130th rank out of 177 countries, or 30th rank among the most corrupt states globally, and is on the first rank as the most corrupt stated in Southeast Asia. The legal education sector policies are necessary as an important stage to reach the national goal, to create Indonesian people who are honest and have integrity. In conclusion, some Indonesia's problems are caused by an excess of imprecise policies in the legal education sector. Thus, commitment and policies in “FREEDOM TO LEARN” need to exist to resolve them. The comprehensive policies may bring the legal education sector to in the correct direction, educate people to be honest, and have integrity in law enforcement.

Honesty as the Fundamental Basis of Legal Education: A Study and Critique on “Freedom to Learn” Educational Policy

This article studied the implementation of law protection model for esthetic beauty clinic‟s patients in citizen‟s constitutional right protection perspective. The research method used was an empirical qualitative on the stakeholders of esthetic beauty clinics in 10 cities in 5 provincial in Indonesia. The result of the research showed that the implementation of legal protection model to aesthetic clinic‟s patients, viewed from implementation content and drug and executor regulations, was less comprehensive and still needed improvement. The Context of Implementation was Ministry of Health and Local Government as leading sector in esthetic beauty clinic service less responsive to the violation esthetic beauty clinics employing executing officers and using medicines and dangerous chemicals inconsistently with the specified guideline. Regulation and Supervision conducted by Ministry of Health, Local Government and Law Enforcer had not run maximally yet. IDI played a very limited role and patients had poor understanding on their right and law protection. As a regulator, the government was recommended to govern the right and the law protection of beauty clinic‟s patients in more detailed; education should be given to the people about healthy and safe cosmetics and about consumptive culture to prevent them from being the victim of beauty clinics that break the law.

Considering Article 28 H of the fourth amendment to the Republic of Indonesia's 1945 Constitution, there is citizen's constitutional right, the right to health and to get healthcare service. Therefore, all healthcare services should fulfill right and obligation of service provider and patient, and medical service standard. Esthetic beauty clinic as a private health service should fulfill it compulsorily. This article studied the factors making the law protection for the patients of esthetic beauty clinic in Indonesia not fulfilling yet the citizen's constitutional right. This study was conducted on stakeholders of esthetic beauty clinic in five provinces in ten cities of Indonesia, using empirical qualitative method. The result of research showed that the factors the law protection for the patients of esthetic beauty clinic in Indonesia not fulfilling yet the citizen's constitutional right.

This article studies the government and the esthetic beauty clinic’s responsibility in fulfilling the citizens’ constitutional right in the service of esthetic beauty clinic in Indonesia. The research method is empirical qualitative to the stakeholders of esthetic beauty clinics in ten cities in Indonesia. The result of the research shows that those responsible for fulfilling the citizens’ constitutional right to the service of Esthetic Beauty Clinic in Indonesia are public and private. The government’s responsibility has been mentioned in Article 28D, clause (1) of 1945 Constitution concerning the right to guaranty, law protection and certainty and Article 28H clause (1) related to the right to health and to get healthcare service. The rights fulfillment is accomplished using the legal instrument and the institution of state authorized in licensing, organization, building, supervision, monitoring, and evaluation in the organization of esthetic beauty clinic. The esthetic beauty clinic’ responsibility includes: fault, risk, product, and professional. These responsibilities have not been fulfilled maximally yet because some law infringements are still found, so the government’s intervention should be optimized with the protection of beauty clinic users’ constitutional rights from upstream to downstream and the regulation as well as the authorized institution should be harmonized.
