International feminist scholarship highlights the benefits of approaching domestic violence policy through a gendered lens. Yet to be examined, however, is the extent to which explicitly gendered domestic violence policies may contain barriers that limit the potential benefits of a gendered approach. This qualitative research examines the assumptions embedded in explicitly gendered domestic violence policy in the Australian state of Queensland. Findings suggest that Queensland's "progressive" domestic violence policy is underpinned by dominant gendered assumptions that reinforce existing unequal social structures. These findings offer important lessons for international jurisdictions that aspire to adopt gendered domestic violence policy.

Striving for Gender Equality: Representations of Gender in “Progressive” Domestic Violence Policy:

Addressing the cultural drivers of domestic and family violence (DFV) has become a core policy priority for governments across Australia. Over the last five years, the Queensland Government has taken a particularly strong stance on the issue through its Domestic and Family Violence Prevention Strategy 2016–2026. This strategy identifies the Queensland Government's leading aim of changing the community culture that drives DFV. Although there is significant evidence to support this aim, there is equally important evidence suggesting that public policies often contain problematic assumptions and ideologies that limit their ability to achieve their aims. This article presents a critical discourse analysis of Queensland's Domestic and Family Violence Prevention Strategy 2016–2026 and related policy documents to examine the assumptions and ideologies underpinning Queensland's policy and their potential to impact on policy outcomes. The findings broadly identify three areas of concern, namely an assumed link between attitudes and behaviours; a disproportionate focus on general community members compared to DFV perpetrators; and an implicit reinforcement of the gender hierarchy. The article concludes with a discussion of the broader implications of these findings for future policy development in Australia.

From aims to actions: A critical analysis of government intervention in cultural drivers of domestic and family violence

The Queensland Government’s Domestic and Family Violence Prevention Strategy 2016–2026 prioritises changing community attitudes and behaviours as a core guiding principle in its commitment to create a Queensland free of violence. Although there is a significant body of research that supports this aim, there is equally compelling evidence to suggest that policies are often designed or implemented ways that are not conducive to achieving their desired aims. As we approach the halfway point in the Strategy’s 2016 to 2026 timeline, it is timely to analyse both the Strategy and its implementation thus far, and consider the barriers that may be preventing the policy from achieving its full potential. Using a critical discourse analysis methodology, I identify a number of such barriers, including an assumed link between attitudes and behaviours; a disproportionate focus on cultural change among bystanders; the invisibility of perpetrators, and; the implicit reinforcement of the gender hierarchy. I discuss each of these barriers in relation to current research evidence and, drawing on this evidence, suggest actions that the Queensland Government may take to help mitigate these barriers. I conclude with a discussion of the broader implications of these findings for future policy development in Australia.

From intentions to implementation: improving alignment between domestic and family violence policy aims and actions

If a person engages in discriminatory conduct by excluding a person from participating in a competitive sporting activity on the basis of gender, section 72(1) of the Equal Opportunity Act 2010 (Vic) renders that conduct lawful provided that the strength, stamina or physique of the competitor is relevant. This paper considers the ambit of this provision, and canvasses the jurisprudence that has developed. It will be advocated that the relatively recent amendment to Victoria's Equal Opportunity Act 2010 (Vic) provides an opportunity for legislative reform that, if taken, could reduce the breadth that Courts have given the strength, stamina and physique provision. Options are suggested which all serve to achieve a common goal - prohibiting the exclusion of women from sport on the basis of gender when they are otherwise able to participate on the basis of merit.
