On April 28, 2015, Shandong Higher People’s Court held a public hearing on the review of Shubin Nie’s case of murder and rape, to solicit the opinions from the claimant, his lawyer and representative of the original case handling court. Such innovative judicial action attracted extensive attention of the jurists, practitioners, the media and the public. Those debatable opinions from some authoritative academic elites confused the public once again.

Reflections on the Miscarriage of Justice in Criminal Cases: Revisit and Reconstruction of the “Corroborative” Mode of Proof in China

The witness presenting at court system has been considerably revised in the criminal procedure law amendment,which was enacted in March 2012.Its purpose is to improve the rate of witness appearing in criminal proceeding.However,the current situation whether can thus be fundamentally changed.In fact,the reasons are numerous as to witnesses fail to present at court.The law amendment tries to resolve this difficult problem only from one hand.This paper makes an effort to discover the causes leading to the failure of witness presenting at court,and then puts forward some positive measures as the reference to the legislator.
