Scholars of culture, humanities and social sciences have increasingly come to an appreciation of the importance of the legal domain in social life, while critically engaged socio-legal scholars around the world have taken up the task of understanding "Law's Empire" in all of its cultural, political, and economic dimensions. The questions arising from these intersections, and addressing imperialisms past and present forms the subject matter of a special symposium issue of Social Identities under the editorship of Griffith University's Rob McQueen, and UBC's Wes Pue and with contributions from McQueen, Ian Duncanson, Renisa Mawani, David Williams, Emma Cunliffe, Chidi Oguamanam, W. Wesley Pue, Fatou Camara, and Dianne Kirkby. This paper introduces the volume, forthcoming in late 2007. The central problematique of this issue has previously been explored through the 2005 Law's Empire conference, an informal but vibrant postcolonial legal studies network.

Political correctness: A history of semantics and culture / Geoffery Hughes

Innovations and advancements in modern technologies have induced changes in every sphere of human activity, including education. Smartphones represent modern, state-of-the-art gadgets which aim at fostering the teaching and learning process of EFL (English as a foreign language) learners. Students may experience and enjoy considerable benefits of these smart devices such as ubiquity, portability, around the clock availability, or numerous technological features. Despite offering overwhelming advantages to language learners, both students and teachers need to take into account challenges they often meet and face. Being in its infancy, this phenomenon appears to be underexplored since majority of studies focus on benefits of mobile learning rather than on challenges. Concentrating on pitfalls, this review article attempts to examine original, peer-reviewed research articles written on smartphone English language learning challenges by reviewing pertinent articles in the two acknowledged databases, Scopus and Web of Science. The research results reveal that the reviewed studies contain identified drawbacks to varying degrees, while approximately one third of articles did not present any challenges. The detected pitfalls, such as smaller dimensions of smartphones, Internet connectivity issues, readiness level of both practitioners and learners, or unbalanced development of the four language skills (listening, reading, writing, speaking), are further addressed and discussed, followed by suggesting the possible solutions to these issues. Finally, it is emphasized that further research needs to be conducted in this regard to shed more light on challenges that both students and practitioners need to tackle.

Smartphone English Language Learning Challenges: A Systematic Literature Review

The aim of this short essay is to highlight and concisely explore-but not address in depth-some cultural aspects related to legal languages, legal interpretation and legal translation. We would like to consider briefly the following questions: How can elements of legal language, as exemplified by proper names and euphemisms, be connected with cultural (extra-linguistic) factors influencing language units' formation? How can judicial discourse reflect the culture of a given justice system? How can the legal interpretation affect the degree of legal culture? Are theories of legal interpretation universal or applicable to specific legal cultures? What is the impact of culture on the context of legal translation? How can the cultural background affect the decision to use terms in translation? How does cyberculture impact legal translation?

The Role of Culture in Legal Languages, Legal Interpretation and Legal Translation

The aim of the paper is to discuss legal language systems as culturally constituted sign-systems that are continuously evolving in time and space. To understand messages formulated in legal languages, one needs to realize that law is culture-bound, which in turn means that law reflects society’s mentality ,tolerance, knowledge, social perceptions, etc. At the same time, law is a living reality impacted by various global phenomena and other legal systems. Therefore, this legal reality has “divergent potentialities”(Hasegawa, Ko. 2016.“A glance at the dynamics of ‘confluence’ in a legal system–notes on H. Patrick Glenn’s insights concerning Legal Traditions of the World”.In Transnational Legal Theory.Vol. 7/1: 1–8, 3), which enable it to develop in various directions depending on wider social, political and technological contexts. Additionally, when communicating law interlingually and intralingually, one needs to take into account the knowledge of senders and recipients since the degree of commensurability of law depends on the uniformity of interpretation on meanings. When discussing the issues of sign meaning interpretation, the authors will focus on non-decomposable units and fuzzy units. The meaning of such terms is subject to interpretation through the prism of tacit knowledge. Therefore, the interpretation of any culturally constituted sign-system is burdened with some loss of information and meaning deficiency.

Despite the intention for precision and accuracy, legal discourse is oftentimes complex, archaic and ambiguous – which gives rise to contentious interpretation. Moreover, little or no attention is paid to the cultural dimension of legal discourse, which plays a critical role in the translation and interpretation of legal texts, as well as in the application of law. This paper endeavours to illustrate the impact the culture, or, more precisely, legal culture has on the way legal texts are construed or translated and to present problems which arise in the interpretation, translation and application of law as a result of cultural diversities.

Cultural Dimensions Of Legal Discourse

The paper reports on a survey into the linguistic needs of law professionals in four European countries, with the aim of identifying their views on the importance and their use of foreign language skills as well as their preferences for ELP course content. The data, obtained from a questionnaire survey of 536 legal professionals from Poland, the Czech Republic, Croatia and Germany, show that while the respondents agree on many of the major points, there are also some differences conditioned by the respondents’ age and the specific tasks they perform in the legal profession. The article argues that these variables have to be taken into consideration in the LSP context because they determine some of the specific needs that need to be addressed in Legal English instruction. It is suggested that the findings about the lawyers’ self-perceived importance and preferred styles of learning are highly relevant for LSP practitioners, particularly when designing Legal English programmes and testing materials.

Addressing the Needs of Lawyers in Legal English: A Comparative Study in Four European Union Countries

Abstract English for Legal Purposes (ELP) appears to be gaining popularity and acquiring a new dimension in many countries. An increasing number of legal professionals (i.e. law students and legal practitioners) consider their General English satisfactory but desire to learn the language of their professional domain, as they believe it will bring them improved job prospects in the future. There are some aspects of ELP teaching that can be both a hindrance and a challenge for ELP teachers. These include the lack of curricula for teaching Legal English at tertiary level institutions and the restricted number of teaching resources and guidelines with reference to teaching Legal English available on the market. This article draws on the outcomes of a three-year research project, which was undertaken to design, implement, and evaluate an ELP programme for adult professionals. The research project was conducted among 293 legal professionals in Poland and took the form of an action research model - a research tool that is not often exploited by scholars despite its unquestionable value

Action Research in Designing and Implementing Courses of English for Legal Purposes

Legal concepts and notions are deeply affected by religions, ethics, philosophy and the culture of a particular nation. As Friedman (in: Nelken (ed) Comparing legal cultures, Dartmouth, Aldershot, 1997, p. 34) highlights, understanding legal culture (i.e. expectations, attitudes, values and ideas towards law and legal institutions) is a crucial factor as it both affects their translation and interpretation and consequently has an impact on the application of law. This increases in importance, for example, in the context of the principle of mutual trust and recognition of judgments assumed by the European Union as the cornerstone of judicial co-operation in the European Union, which would not be possible without the trust in each other’s justice system and the respect for the different legal systems and traditions of the Member States. In that vein, ‘the Third Space’ (i.e. the legal translation process), where legal concepts and notions of multiple origins meet and where their meanings are negotiated, transformed, translated and integrated into various socio-political and cultural contexts has acquired an immense significance. Although there may be natural similarities between legal professions in the European Union, they could differ quite substantially as they are deeply rooted in the history and societal evolution of a country; therefore, they are generally regulated at a national, not a European level. In light of the above, the author intends to perform an in-depth analysis of key terminology in the field of names of legal professions which exist in the Member States of the European Union. The author focuses on the terms which refer to the legal profession of lawyers as they might pose obstacles in translation and interpretation due to different functions and roles these legal professionals play in their legal systems or due to the lack of their equivalents in other legal systems. The terminology is compared to present similarities and differences in their meaning, particularly putting some emphasis on socio-political and cultural contexts. The research methods encompass the analysis of relevant literature and the terminological analysis of the research material, which includes the information on legal professions provided by particular Member States on the European e-Justice portal and relevant national regulations in that respect. Finally, the author draws the conclusion that a thorough analysis of the functions and roles of a particular legal profession in socio-political and cultural contexts is required before the translation and interpretation of the term is provided as it helps to avoid ambiguity and makes legal communication precise.
