Medicine and law were related from early times. This relation resulted as a necessity of protecting communities from the irresponsible acts of impostors. Various legal codes dealing with medical malpractice existed in Egypt, Mesopotamia, China, Islam, Greece, Rome, Persia and India. Over the course of the past 30 years, interest in the history of psychiatry has boomed. Much of this proliferation of interest has taken place under the broad influence of postmodernism and has resulted in multiple and diverse histories that no longer seek to provide a linear narrative of constant evolutionary progress. Rather, these new histories explore and disrupt taken for granted assumptions about the past and provide a starting point for discussion and debate about the some of the very foundations of mental health care in South Africa. As a matter of practical importance knowledge of how knowledge accrues and knowledge of the mistakes of the past is of prime importance in preventing similar mistakes in present and future work. An important reason for specifically understanding historical psychiatry is the fact that many of the uncertainties experienced in the present are a direct result of decisions made in the past. The key issue is that while it is tempting to experience current psychiatric and legal approaches towards the mentally disordered as natural and permanent, an understanding of the past helps mental health and legal practitioners to see things in a different perspective. Psychiatric and legal approaches towards the mentally disordered have changed over time and can undoubtedly also be changed in future. Therefore, the research conducted in this article focuses on the history and development of law and psychiatry including prehistoric times, the Arabian countries, the Nile Valley as well as Greece and Rome.

The Code of Hammurabi is a collection of at least 282 ancient Mesopotamian laws that King Hammurabi promulgated near the end of his reign (1792–1750 bce). Hammurabi's Code represents one of the first written attempts by an ancient civilization to systematically codify civil and criminal laws. The Code is important to penologists and criminologists because it demonstrates how one of the oldest known civilizations responded to criminal violations. Although the original text was lost around 1565 bce and not rediscovered until 1901, most of the principles inherent in the Code became points of reference for future legal and religious development.

THE spade has brought to light many important finds during the past half-century. Few surpass in interest and importance the law-book of Hammurabi. It was discovered in Susa, the capital of Elam, by the French explorers de Morgan and Scheil, while excavating during the months of December, I90I, and January, I902. It has I1OW been edited by Scheilt in a handsome volume, with a translation in French, atranscription of the cuneiform text, and a photograph of the inscription. Hammurabi vtras the sixth king2 of the first Babylonian dynasty. He ruled about 2250 B. C. and was the first king of a united Babylonia. He was, indeed, the real founder of Babylon and the Babylonian empire. Hammurabi was not only a great warrior, but also a distinguished statesman, who did much for the internal improvements of the land, as his inscriptions3 show. His interest in literature is seen by his preserving in Babylon the best products of the old Sumerian culture. His capital became a home of scholars whose influence was far-reaching. Indeed, we may call Hammurabi's reign the Augustan age of Babylonian literature. He showed a deep interest in the religious welfare of his empire by repairing old temples and building many new ones, by caring for the statues of the gods, and by regulating the revenues of the sanctuaries. Hammurabi must be considered one of the great rulers of the world. The epithets which he attributes to himself in the prologue and epilogue of the code seem to be well
