Constructing Grounded Theory: A Practical Guide through Qualitative Analysis

Restorative justice is a new movement in the fields of victimology and criminology. Acknowledging that crime causes injury to people and communities, it insists that justice repair those injuries and that the parties be permitted to participate in that process. Restorative justice programmes, therefore, enable the victim, the offender and affected members of the community to be directly involved in responding to the crime. They become central to the criminal justice process, with governmental and legal professionals serving as facilitators of a system that aims at offender accountability, reparation to the victim and full participation by the victim, offender and community. The restorative process of involving all parties – often in face-to-face meetings – is a powerful way of addressing not only the material and physical injuries caused by crime, but the social, psychological and relational injuries as well.

Las Comisiones de la Verdad (CV) constituyen un mecanismo de justicia transicional muy importante, pero su efectividad es dificil de medir. Este articulo sugiere tres categorias para medir el impacto de las CV: el cumplimiento de sus mandatos y objetivos; la expedicion de un reporte final; y, el logro de cierto impacto politico con sus recomendaciones (Brahm, 2007; Ceballos Medina, 2009). La propuesta de una Comision Colombiana de la Verdad expedida por el Gobierno y las FARC-EP el 4 de Junio de 2015 es analizada aqui bajo estas categorias para determinar retos y oportunidades para su implementacion. Este es un ejercicio pragmatico que se enfoca unicamente en la propuesta pero que reconoce que la construccion de verdad y memoria historica depende de muchos otros aspectos de las negociaciones.

Labor Rights as Human Rights

This study investigates perceptions of the Liberian Truth and Reconciliation Commission (TRC), particularly focusing on understandings of, and the links between, truth, justice, and reconciliation. Forty-five semistructured interviews were conducted at three research sites in Liberia. Findings indicate that although most Liberians agreed with the TRC in principle, most of those who followed its proceedings saw major problems in its implementation, harming perceptions of reconciliation. Participants expressed concerns that the Commission had failed to discover the full truth of wartime abuses, that the truth that was discovered was not told in the right way, and that there had been problems implementing justice. The data indicates that societies recovering from violence and suffering must think carefully about how to revisit their pasts. In order for a truth commission to have a positive impact, it must ensure that truth is told in a reconciliatory fashion, and that its justice-based strategy enjoys popular support.
