Dalam penulisan jurnal yang berjudul “Tata Cara Penuntutan Hak Waris Oleh Ahli Waris Yang Sebelumnya Dinyatakan Hilang Berdasarkan Kitab Undang-Undang Hukum Perdata” penelitian yang digunakan dalam tulisan ini adalah penelitian hukum normatif, dimana untuk mencari bahan-bahan yang kemudian dikaji menggunakan peraturan perundang-undangan serta menggunakan literatur bacaaan. Mengenai seseorang ahli waris yang hilang atau dalam keadaan tak hadir, maka segala hak-haknya tentu menjadi suatu permasalahan karena menyangkut kedalam hukum keluarga dan perorangan, dengan demikian terdapat permasalahan yang diperoleh yaitu bagaimana tata cara penuntutan hak waris oleh ahli waris yang sebelumnya dinyatakan hilang tersebut serta bagaimana akibat hukum terhadap ahli waris yang dinyatakan hilang tersebut. Dalam kesimpulannya, penuntutan hak waris oleh ahli waris yang sebelumnya dinyatakan hilang tersebut dapat dilaksanakan sesuai dengan peraturan yang berlaku yaitu sebelum undang-undang menyatakan putusan terhadap hilangnya seseorang tersebut kadaluwarsa yaitu maksimal 30 tahun setelah hari pertama hilangnya sesorang tersebut. Sedangkan akibat hukum terhadap ahli waris yang dinyatakan hilang tersebut menimbulkan suatu akibat hukum yaitu lahirnya suatu hubungan hukum mengenai adanya ahli waris pengganti yang menggantikan kedudukan ahli waris yang hilang tersebut.
